Conditions of use
1. Introduction
1.1. These Terms and Conditions constitute a legally binding agreement (hereinafter « Agreement ») between you (hereinafter « User ») and Linkesim Limited, a limited liability company incorporated and registered in Hong Kong with company number 76468323 and headquartered at Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong S.A.R., China (hereinafter « Linkesim » or « we »), regarding the purchase of an international internet subscription/plan (hereinafter « internet subscription, plan ») in the form of a prepaid eSIM card (hereinafter « eSIM » or « eSIM Card ») for use on a personal device (hereinafter « device ») from Linkesim (hereinafter, the « Service »).
1.2. Future Agreements between the User and Linkesim may add additional Terms and Conditions or other documents, which will be posted on our website or online site (hereinafter « Website »).
1.3. We recommend that you print these Terms and Conditions for future reference.
2. Registration
2.1. The User may register to purchase an eSIM via our website: www.linkesim.com. Registration and purchase can only be completed upon acceptance of these Terms and Conditions of Use. Linkesim’s Privacy Policy and Cookie Policy are displayed on our website during the User’s registration process.
3. Purchase and Activation of an eSIM
3.1. If you purchase an eSIM, you enter into an Agreement with us for this purchase and agree to pay all applicable charges as specified by the Subscription or Plan or Internet Plan associated with the eSIM card in question.
3.2. You are responsible for this eSIM card upon receipt. Full payment for your eSIM card is due, even if your Device is damaged or lost prior to payment.
3.3. You may also purchase an eSIM from a Linkesim partner (hereinafter « Third Parties »). If you purchase an eSIM from a Third Party, you enter into an Agreement with that Third Party, and Linkesim is not a party to this agreement.
3.4. Linkesim is committed to providing Subscriptions or Internet Plans suited to specific countries. Linkesim reserves the right to limit the availability of such Subscriptions or Internet Plans in certain jurisdictions. Our Users may search, select, and purchase our Subscriptions or Internet Plans via our Website or through Third Parties.
3.5. By subscribing to our Service, the User acknowledges that they have an unlocked, eSIM-compatible device as required.
4. Term and Cancellation
4.1. This Agreement takes effect upon the purchase of an eSIM card. Once the eSIM Card is downloaded to your Device and the Subscription or Internet Plan is activated, it remains on the Device even after the Subscription or Internet Plan credit is exhausted or the subscription expiry date is reached. The User is free to delete the eSIM Card from their device at any time, but we strongly recommend keeping it as long as the Subscription or Internet Plan credit is not exhausted or the usage expiry date is not reached. Downloading an eSIM Card and activating the associated Subscription or Internet Plan may require a stable internet connection.
4.2. The terms of this Agreement apply as long as the Subscription or Internet Plan credit is not exhausted or the usage expiry date is not reached, as specified in the description of the purchased Subscription or Internet Plan.
4.3. This Agreement will terminate immediately if any of the following events occur:
4.3.1. The Subscription or Internet Plan is fully used or expires, in accordance with clause 4.2;
4.3.2. suspension by Linkesim or the User of the use of the eSIM Card or Subscription or Internet Plan due to a violation of these Terms and Conditions (including violations of applicable laws and regulations).
4.4. Should such termination occur in accordance with clause 4.3.1 of these Terms and Conditions, if the User does not promptly delete the eSIM Card from their device following the exhaustion or expiry of the associated Subscription or Internet Plan, the eSIM Card is then provided as-is and no longer carries any warranty. In accordance with clause 4.4, Linkesim will not be liable for any dispute related to such an eSIM Card unless another Linkesim eSIM Card or Internet Subscription is purchased—in which case, these Terms and Conditions will once again apply.
5. Warranty
5.1. These Terms and Conditions supplement your statutory consumer rights.
5.2. Linkesim provides no warranties or representations regarding the eSIM Card or Service, and all warranties and conditions (except to the extent required by applicable laws and regulations), whether express or implied under applicable statutes or laws, are excluded to the fullest extent permitted by law.
5.3. Linkesim reserves the right, at its sole discretion, to cease the sale, delivery, or support of any eSIM card at any time.
6. Service Availability
6.1. Linkesim is committed to taking all reasonable measures to ensure the User’s continuous access to the Service, within the capabilities of Linkesim’s service providers to maintain network capacity and connection availability.
6.2. Linkesim provides its services through partnerships with service providers. Linkesim is under no obligation to notify the User of the use of third-party partners to support Service availability.
6.3. Linkesim does not guarantee network capacity, quality, or Service connection availability. This includes, but is not limited to, the following circumstances:
6.3.1. A service provider needs to perform a network upgrade, maintenance, or other operation;
6.3.2. The User is in an area not covered by our service provider’s network or not included in the areas specified by the Subscription or Internet Plan subscribed to;
6.3.3. Factors beyond our control cause service disruptions, such as Device incompatibility, regulatory requirements, defective networks, radio or weather interference, or any other physical obstructions.
7. User Obligations
7.1. The User agrees:
7.1.1. To use the eSIM Card in accordance with these Terms and Conditions;
7.1.2. To use the eSIM Card in compliance with the laws and regulations of the country of the User’s presence or residence;
7.1.3. Not to use the eSIM Card for any fraudulent, criminal, or illegal activity or in a way that could harm network integrity;
7.1.4. Not to use the eSIM Card to copy, store, modify, publish, or distribute Linkesim’s commercial information (including trade secrets) without Linkesim’s explicit permission;
7.1.5. Not to use the eSIM Card to download or send content in volumes, quantities, or frequencies deemed excessive;
7.1.6. Not to use the eSIM Card in a way that would violate any third party’s intellectual property.
7.2. The User agrees that any discount, promotion, or Service referral (hereinafter, « Promotions ») shall not be used in a way that could impair the fairness, integrity, or smooth operation of the Service, including, but not limited to, creating fake user accounts or using a false identity to participate in and benefit from a Promotion.
7.3. The User agrees that Linkesim may terminate the Service if the terms of these Terms and Conditions are violated. In this case, the User remains responsible for the payment of all Service-related charges, as defined by these Terms and Conditions. Linkesim reserves the right to seek compensation (including legal fees), within the bounds of the law.
7.4. Linkesim reserves the right, at its sole discretion and without liability to the User, to delete a User account or disqualify a User from using the Service or participating in any Promotion.
